in our legal guys. avery freedman in cleveland, ohio. and richard hermann, new york criminal defense lawyer joining us from las vegas. richard, the supreme court has choices of cases it could take here. it decided to take these two, doma and proposition 8. why do you think they took these and not others? >> you know, after this election, this issue is so ripe for the supreme court the jurisdictions are so split in their laws, many states recognizing same-sex marriage and performing same-sex marriages. some states not recognizing them. this is the perfect scenario for the supreme court to step in and ultimately make a ruling. there are over 1,000 cases, joe, in which federal laws are impacted by marital status. the time has come. it's ripe. prop 8 was on the doorstep for the supreme court. here we go. >> avery, we were trading e-mails a little bit a while ago. one of the questions i asked you was whether the supreme court essentially gave itself an emergency escape hatch with one of the cases it chose. can you talk about that? >> late yesterday, as you know, joe, the supreme court ame

in our legal guys avery freeman who is in cleveland and richard herman, he joins us from las vegas. so, gentlemen, everybody was excited about this. this is about equal protection. there were ten cases -- a total of five case that's the supreme court could have considered on this particular issue. why did they decide to pick any of them? avery? >> actually, they may very well take one of them, deb. what's going to happen here is, you're correct, there were ten petitions, five cases, one involving prop 8, the referendum in california and the 1996 congressional prohibition. there are so many questions. question is will the supreme court take the case? i think it would have really been impossible for the justices to make a decision on friday. they're going to continue to deliberate and i think we look forward to seeing something going to the supreme court. we just don't know which one of the cases the court will accept. >> richard, you know what's interesting about this is one of the reasons that it's likely they're going to consider this is you have a state law which is overriding a fede

homes. so what does that mean for gun control today? let's bring in our legal guys, avery freedman, civil rights attorney and law professor in washington and richard herman, new york criminal defense attorney and law professor, joins us from las vegas. avery, is there any room for gun control here? >> yeah. a ton of it. miguel, that 2008 decision that you referred to, that case really provided the open door. even justice scalia, one of the most conservative members of the court and writing for the majority, talked about unusual and dangerous weapons being permitted to be regulated. so i think heller really offers congress an opportunity to get serious, show some backbone, take advantage of the existing constitutional law, what the tragedy means, what comes out of connecticut, and take action in dealing with arms regulation. i think the opportunity is there. i think they can get it done. >> richard, what would meaningful gun control legislation or laws look like that would get by the supreme court? >> that's a great question, miguel. we're going to find that out in the next year or

ago. the suspect was armed inside of the avery park apartment, hold up inside an apartment. buff the neighbors we're told are safe. everyone in the immediate area was evacuated although we don't have an exact number. the suspect alone in the apartment. there was never a hostage situation. corporal maria mckinnie, she had some advice for neighbors, many of them who are waking up this morning who are talking to us, confused about what is happening here, trying to get out of the neighborhood. she has some advice for those residents. let's listen to what she had to say. >> the recommendation that we give at this time is to just continue on about their day, just let them know that the situation is under control and we have officers on the scene who are negotiate -- who are negotiating with the suspect. >> reporter: again you can see outside the avery apartments in adelphi. you can see a police cruiser pulling away. a lot of activity. seems like crews are shifting. we will get back you to as soon as we can with an update as to whether or not this barricade situation in adelphi has come

. an ambulance left the avery park apartment complex here in adelphi. we understand the suspect was inside. a police officer on the scene for prince george's county tells me he was injured. that's all we know at this point. it looks like things here could be wrapping up shortly. in the distance, you can probably see a swat vehicle. now, these crews have been out here since about 10:00 last night. news 4 was first on the scene. you can take a look at some of that video of the swat team coming in about eight hours ago. several apartment buildings had to be evacuated. here's what we know about this situation developing over the past couple of hours. u.s. marshals came to the complex to make an arrest on monday night. they had an altercation with the suspect who then barricaded himself inside the apartment down the hill here. he was armed but did not have any hostages. prince george's county police, u.s. marshals were trying to negotiate with him for the past couple of hours. sources out here on the scene telling us he may have been involved in a recent carjackings and that is why he was arres

avery. >> it is nice to see much improvement across the roads compared to yesterday. the winter storms still tracking to the northeast, causing problems for holiday travelers, with delays at newark and laguardia. b i c mix to the west, and continuing to fall across upstate new york and into maine, causing trouble at the latest into the evening hours. the wind on the backside of the storm has caused some worry. we have not changed from the morning hours. we were at 37 and bwi marshall. look where we are now, 39 degrees. strong winds from the northwest has prevented temperatures from rising at all. 42 in annapolis, 37 in gaithersburg and frederick. still in the middle 30's in westminster. the problem with the wind, it makes it feel colder. wind gusts up to 40 miles per hour close to the airport, 24 miles per hour in ocean city. the sustained wind has been anywhere from 20 to 30 miles per hour across the majority of the state. the wind is still whipping around the trees and the power lines. as you are traveling across the area, we're seeing concerns with that as the wind could push the ca

contributor and civil rights and law professor avery friedman. morning, avery. >> good morning, carol. >> i think the thing that stands out for most people is that this man was convicted of murder for killing his grandmother who was 92 years old. apparently he beat her to death and he was on parole. he only served 17 years. how is that possible? >> yeah, it seems impossible to happen. but if you study this, spengler was in his late 20s when he committed this murder. and one would expect that he would have spent the rest of his life in the new york penal system. the fact is, though, that he was paroled out and actually had an obligation to report to his parole officer until this happened. but the fact is that it struck me as virtually impossible for the parole department not to know that this guy was a problem. the fact that he committed this murder -- again, even though he was in his 20s, unless he was a model person in the penitentiary, it would seem pretty obvious that there was a problem with this guy and of course the worst happened here. and we will never know, although we do tend to t

was made and london, where it was received. and police in the two countries are investigating. avery friedman is a civil rights attorney and law professor. he joins us now from cleveland. a avery, we're talking about two countries. two separate sets of laws. who takes the lead in something like this? >> well, the alleged crime of course occurred in aus trtralia but the fact is that the law that officials are looking at right now, ted, is the a law that deals with basically those people engaged in stalking. intentional harassment and coercion. it's not a law, in fact, this is a case, ted, that will never resolve in criminal charges. i think the tougher question is will there be civil liability arising out of the case. >> and what's the clanhances of that? did you say there's no criminal case here. i would think. from layman's term because these radio stations across the world do this on a daily base and nobody could have forseen the tragedy here, but civilly, what would it take for a successful civil suit? really, the facts of this are the same whether you're talking criminal or civil

: we know they've been here for several hours at this point. they're focusing in on the avery park apartments that's right behind us. residents in this general area waking up to heavy police activity. take a look. they have been here since 10:30 last night. that was soon after prince george's county police assisting a u.s. marshal were trying to serve an arrest warrant. let's take a look at some video we shot some time ago when the scene was still very, very active. the suspect we're told is armed inside the apartment but neighbors are safe. we're told an unknown number living in the immediate area have been evacuated. the suspect is alone inside the apartment. no host arches at this point. -- hostages at this point. negotiations are ongoing we're told. we spoke to corporal maria mckenny with prince george's county police a short time ago. here's what she had to say. >> at this time the person is armed and barricaded themselves insides the apartment. and we're hoping that this person through ongoing negotiations will come out peacefully and unarmed. >> reporter: again, they're hopi

at any level can take a hit on his family, but avery johnson's son is hitting back. bleacher reports joins me now to talk about the new jersey nets. this is unbelievable. he was just coach of the month and now he's out. >> he was for october and november and then gone by new year's. this is the life in the nba for a head coach. there were a number of factors involved though including him being in the final year of a contract. this team had high expectations. they moved from new jersey to brooklyn. big payroll, but they had underperformed. after a great start, he was coach of the month, 3-10 in the month of december. then with the free agents not playing well including darrin williams, his team leader, insiders say he may have lost the locker room and there was too much at stake. but interesting what you're talking about, family members. avery johnson jr. reaches out with a few tweets.
